affiliates be liable for any special, incidental, indirect, or consequential damage
whatsoever (including without limitation, damages for loss of business profits, business
interruption, loss of business information, or any other pecuniary loss) arising out of
the use or inability to use the Format, even if they have been advised of the possibility
of such damages.
You agree to defend, indemnify and hold the
Creator and its affiliates and their directors and employees harmless from any and all
liabilities, cost and expenses, including legal costs and fees, related to any violation
of this Agreement by you.
This Agreement shall be governed and
construed in accordance with the laws as applicable in Mumbai, India.
